1.2 Legal Status and Acknowledgment

You acknowledge that the commercial sale of cannabis products in South Africa is subject to evolving regulations and stringent licensing requirements under the oversight of the South African Health Products Regulatory Authority (SAHPRA) and the Department of Agriculture, Land Reform and Rural Development (DALRRD). While we operate in compliance with all applicable laws for which we are licensed, you agree that you are purchasing products for use at your own discretion and risk, as detailed in Part 7 of these Terms.

PART 2: THE G BLISS CLUB MEMBERSHIP

2.1 Membership Requirement

Access to our website and the ability to purchase products is restricted exclusively to registered members of the G Bliss Club ("the Club"). By registering for membership, you warrant that you will:

  • Provide accurate, current, and complete information as prompted by our registration forms.

  • Maintain the security of your account credentials, including your password.

  • Promptly update any changes to your information, particularly your contact details and delivery address.

  • Not share your account credentials with any third party. You are fully responsible for all activities that occur under your account.

2.2 Membership Eligibility

Membership is strictly limited to individuals who:

  • Are 18 (EIGHTEEN) years of age or older.

  • Are legally competent to enter into binding contracts under South African law.

  • Reside in jurisdictions within South Africa where the purchase and possession of our products is legal.

  • Provide valid proof of age and identity upon request.

2.3 Membership Account Security

We regard the security of your account as your responsibility. We will not be liable for any loss or damage arising from your failure to comply with this clause. If you suspect any unauthorized use of your account, you must notify us immediately.

2.4 Membership Termination and Suspension

We reserve the right to suspend or terminate any membership at our sole discretion and without notice, particularly where we suspect:

  • The member is under the age of 18 years.

  • Fraudulent, abusive, or illegal activity.

  • A breach of any of these Terms.

  • Providing false or misleading information during registration or purchase.

PART 3: AGE VERIFICATION AND COMPLIANCE

3.1 Strict Age Restriction

STRICT AGE RESTRICTION APPLIES: No person under the age of 18 (EIGHTEEN) years may become a member, browse our website, or purchase our products. This is a non-negotiable condition of use.

3.2 Verification Process

By registering and making a purchase, you:

  • Confirm, under penalty of perjury, that you are over 18 years of age.

  • Consent to age verification checks, which may include requests for copies of your ID document or driver's license.

  • Acknowledge that our delivery personnel are authorized and required to request age verification upon delivery.

  • Agree that failure to produce valid identification upon delivery constitutes a breach of these Terms and grounds for cancellation of the sale.

3.3 Misrepresentation

Knowingly misrepresenting your age to purchase cannabis products is a serious offense. We reserve the right to report any suspected underage purchasers or those who provide false information to the relevant South African authorities and to pursue legal action, including claims for damages.

PART 4: PRODUCT INFORMATION AND COMPLIANCE

4.1 Products Offered

G Bliss offers various cannabis, cannabidiol (CBD), and industrial hemp products for online sale and delivery only, as permitted by our licenses. Product descriptions, images, and specifications are provided for informational purposes only and do not constitute a guarantee of effect or suitability.

4.2 Compliance with South African Standards

In compliance with the Consumer Protection Act 68 of 2008 (CPA), we confirm that our products are labeled with a trade description as defined in Section 24 of the Act, including information on ingredients, quantity, and country of origin. We endeavor to ensure that all goods supplied are of good quality, in good working order, and free of any defects, as required by Section 55 of the CPA.

4.3 Specific Cannabinoid Compliance

You acknowledge that:

  • THC Products: Products containing Tetrahydrocannabinol (THC) are scheduled substances. They are available only on prescription from a medical practitioner and can only be dispensed in accordance with a valid prescription, where legally permitted.

  • CBD Products: Products containing Cannabidiol (CBD) comply with the legal thresholds for Schedule 0 (unscheduled) substances, containing no more than 0.0075% CBD and 0.001% THC, or are dispensed in accordance with a prescription for higher concentrations.

  • Hemp Products: Any industrial hemp products we sell (e.g., textiles, cosmetics) comply with the THC concentration limits of 0.01% or less for fiber products and 0.001% for seed products, as required by DALRRD, and are not marketed for ingestion.

4.4 No Medical Claims

Our products are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Any perceived therapeutic benefits are anecdotal and not guaranteed. We make no medical claims regarding our products. You are strongly advised to consult with a healthcare professional before using any cannabis products, especially if you have pre-existing medical conditions or are taking other medication.

4.5 Product Hazards and Warnings

In compliance with Section 58 of the CPA regarding warnings on hazardous products, we provide the following warnings, which are also displayed on our product packaging:

  • Cannabis products may impair judgment, coordination, and cognitive function.

  • Do not drive or operate machinery under the influence of our products.

  • Keep all products out of reach of children and pets. This product is not for use by children.

  • Consult a healthcare professional before use if you are pregnant, planning to become pregnant, or nursing.

  • This product may be habit-forming. Use responsibly.

PART 5: ORDERING, PAYMENT, AND PRICING

5.1 Order Process

All orders are subject to acceptance and availability. Placing a product in a shopping cart or completing the checkout process does not constitute an acceptance of your order. We reserve the right to refuse or cancel any order for any reason, including but not limited to:

  • Suspected underage purchasers.

  • Orders that violate these Terms.

  • Inability to verify age or identity.

  • Product unavailability.

  • Errors in product or pricing information.

  • Suspected fraudulent activity.

5.2 Order Confirmation

A legally binding agreement between us and you is formed only when we send you an email confirming that your order has been dispatched ("Order Confirmation"). Any prior acknowledgments, including automated responses to order placement, are for informational purposes only.

5.3 Pricing

  • All prices are in South African Rand (ZAR) and include Value-Added Tax (VAT) at the prevailing rate, where applicable.

  • We take reasonable care to ensure that all prices are correct at the time of publishing. However, if an error is found, we will inform you as soon as possible and offer you the option of reconfirming your order at the correct price or cancelling it.

  • We are under no obligation to sell a product at an incorrect price, even after an order confirmation has been sent, if the pricing error is obvious and unmistakable.

5.4 Payment

Payment must be received in full before your order is processed. We accept payment via Visa and MasterCard via PayFast. By submitting an order, you authorize us to perform a credit check or verify your payment details with your financial institution.

PART 6: DELIVERY BY THIRD-PARTY COURIERS

6.1 Delivery Only Business Model

G Bliss operates exclusively as an online retailer. We do not maintain a physical store, walk-in premises, or collection point. All sales are strictly for delivery only through third-party courier services.

6.2 Use of Third-Party Couriers

We engage independent courier companies ("Delivery Partners") to deliver all orders. By placing an order, you acknowledge and agree that:

  • Your products will be delivered by a third-party courier.

  • The courier's own standard terms and conditions may apply to the delivery.

  • We are not responsible for the acts or omissions of the Delivery Partner, except as required by law. We will, however, take reasonable steps to assist you in resolving issues with the courier.

6.3 Age Verification at Delivery

Our Delivery Partners are contractually obligated to verify the age of the recipient. All deliveries require the recipient to be 18 years or older and to present a valid form of identification (ID book, smart ID card, or driver's license). If no person over 18 with valid ID is available to accept delivery:

  • The courier will not release the package.

  • The package will be retained for a second delivery attempt or returned to our facility.

  • Additional delivery charges may apply for re-delivery attempts.

6.4 Delivery Time Frames and Liability

Delivery time frames provided at checkout are estimates only and are not guaranteed. To the maximum extent permitted by law, G Bliss shall not be liable for any delay in delivery caused by events outside our reasonable control or the reasonable control of our Delivery Partners (e.g., weather, traffic, labor disputes, customs clearance).

6.5 Passing of Risk

Risk of loss, damage, or deterioration to the products passes to you upon delivery to the address provided, or when the products are accepted by you or your authorized representative. While products are in the possession of the Delivery Partner, they are carried at your risk.

6.6 Failed Deliveries and Incorrect Addresses

If delivery fails due to an incorrect or incomplete address provided by you, or because no one was available to receive the package:

  • Original delivery charges are non-refundable.

  • You will be responsible for all return-to-sender courier charges and any additional re-delivery charges.

  • Refunds will not be issued for orders that cannot be delivered due to address errors or recipient unavailability.

PART 7: DISCLAIMER OF LIABILITY AND ASSUMPTION OF RISK

7.1 Personal Responsibility

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT:
All products are used at your sole discretion and risk. G Bliss, its directors, employees, affiliates, or agents shall NOT be held responsible for:

  • Any adverse reactions, side effects, or health consequences resulting from product use.

  • Any interactions with medications, alcohol, or other substances.

  • Any accidents, injuries, or damages arising from product use.

  • Any decisions made or actions taken while under the influence of our products.

7.2 Limitation of Liability

To the maximum extent permitted by South African law, including the CPA, G Bliss disclaims all liability for any direct, indirect, incidental, special, consequential, or punitive damages arising from or relating to:

  • The use or inability to use our products.

  • Reliance on any product information provided.

  • Errors, omissions, or inaccuracies in product descriptions.

  • Loss of income or profits.

  • Any delay or failure in performance.

7.3 Indemnification

You agree to indemnify and hold G Bliss, its officers, employees, and agents harmless from any claims, losses, liabilities, damages, expenses, and costs (including reasonable legal fees) arising from:

  • Your violation of these Terms.

  • Your use of our products.

  • Your violation of any rights of a third party.

  • Your violation of any applicable laws or regulations, including those pertaining to the possession and use of cannabis products.

PART 8: RETURNS AND REFUNDS

8.1 General Return Philosophy

Due to the nature of cannabis products and strict health and safety regulations, we maintain a limited return policy. Cannabis products, once sold, cannot be resold due to health and safety concerns.

8.2 Defective or Non-Compliant Products

In accordance with Section 55 and 56 of the CPA, you are entitled to a refund or replacement for goods that are defective, unsafe, or not of good quality. If you believe you have received a defective product:

  1. Do not use the product.

  2. Contact us within 7 (SEVEN) days of delivery.

  3. Provide your order number, clear photographs, and a description of the issue.

  4. We will investigate and, if the defect is confirmed, offer a replacement or a full refund including delivery costs.

8.3 Non-Returnable Items

We do not accept returns or provide refunds for:

  • Change of mind.

  • Products that did not meet personal expectations regarding effects, taste, or aroma.

  • Products purchased by mistake.

  • Opened or used products, except in cases of verified defects as outlined in 8.2.

8.4 Returns Process

All returns require a Return Authorisation (RA) number. Unauthorized returns will be refused.

PART 9: PRIVACY AND DATA PROTECTION (POPIA COMPLIANCE)

9.1 Our Commitment

We are committed to protecting your privacy and handling your personal information in compliance with the Protection of Personal Information Act 4 of 2013 (POPIA) and its latest Regulations.

9.2 Information We Collect

We collect personal information necessary for our services, including:

  • Registration Information: Name, date of birth, ID number, contact details, address.

  • Age Verification Information: Copies of ID documents (special personal information).

  • Transactional Information: Purchase history, delivery instructions, payment confirmations.

  • Technical Data: IP address, browsing behavior, device information.

  • Communications: Records of your correspondence with us.

9.3 Lawful Processing

We process your information on the following lawful bases:

  • Performance of a contract: To fulfill your orders and manage your membership.

  • Legal obligation: To comply with age verification and record-keeping laws.

  • Legitimate interest: To improve our services, prevent fraud, and ensure network security.

  • Consent: For direct marketing communications and the processing of special personal information.

9.4 Direct Marketing

We will only send you direct marketing communications (newsletters, promotions) if you have given us your explicit, written consent. You may opt out of receiving such communications at any time, free of charge, by using the unsubscribe link in any marketing email or by contacting us directly.

9.6 Data Subject Rights

Under POPIA, you have the right to:

  • Request access to the personal information we hold about you.

  • Request correction or deletion of your information if it is inaccurate, irrelevant, or excessive.

  • Object to the processing of your information for direct marketing purposes.

  • Withdraw your consent at any time.

  • Lodge a complaint with the Information Regulator.

To exercise these rights, please contact our Information Officer using the details in Part 1. We will respond to your request within a reasonable time, generally within 30 days.

9.7 Security Breaches

In compliance with Section 22 of POPIA, if we have reasonable grounds to believe that your personal information has been accessed or acquired by an unauthorized person, we will notify the Information Regulator and you (the data subject) as soon as reasonably possible.

PART 10: INTELLECTUAL PROPERTY

All content on our website, including but not limited to logos, text, images, graphics, product descriptions, and software, is the property of Gracia Services trading as G Bliss or its content suppliers and is protected by South African and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, display, or prepare derivative works of any such content without our express written permission.

PART 11: GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising under these Terms that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the courts of South Africa. This does not affect your right to approach the applicable consumer court or the National Consumer Commission (NCC) in terms of the CPA.

PART 12: CONSUMER PROTECTION ACT RIGHTS

Nothing in these Terms is intended to limit any rights you may have under the Consumer Protection Act 68 of 2008. To the extent that any provision of these Terms conflicts with the CPA, the provisions of the CPA shall prevail. These Terms do not purport to waive or modify your rights as a consumer under the CPA where such rights may not lawfully be waived or modified.

PART 13: GENERAL PROVISIONS

13.1 Entire Agreement

These Terms, together with our Privacy Policy, Return Policy, and Delivery Policy (all of which are incorporated herein by reference), constitute the entire agreement between you and G Bliss regarding the use of our website and the purchase of our products.

13.2 Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

13.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver of any provision of these Terms will be effective only if in writing and signed by a duly authorized representative of G Bliss.

13.4 Amendments to Terms

We reserve the right to update or modify these Terms at any time without prior notice. The updated version will be posted on our website with a revised "Last Updated" date. Your continued use of our website and services following any changes constitutes your acceptance of those changes.

2. GENERAL RETURN PHILOSOPHY

3. DEFECTIVE OR NON-COMPLIANT PRODUCTS

  • Are of good quality, in good working order, and free of any defects

  • Will be useable and durable for a reasonable period of time

  • Comply with any applicable standards set under any public regulation

3.2 What Constitutes a Defective Product

You may be eligible for a return, replacement, or refund if you receive products that are:

  • Contaminated or unsafe for consumption

  • Significantly different from the description on our website

  • Past the stated expiration date

  • Damaged due to packaging failure during transit

  • Incorrect products (different from what you ordered)

3.3 Reporting Defective Products

If you believe you have received a defective product:

  1. Do not use the product

  2. Contact us within 7 (SEVEN) days of delivery

  3. Provide your order number, clear photographs of the product and packaging, and a description of the issue

  4. Retain the product and original packaging until instructed otherwise

We will assess your claim and respond within a reasonable timeframe.

4. INCORRECT ORDERS

4.1 Wrong Item Received

If you receive an incorrect product:

  • Contact us immediately upon discovery

  • Do not open the product packaging if possible

  • We will arrange for collection of the incorrect item and dispatch the correct item at no additional cost to you

4.2 Shortages

If your order arrives missing items:

  • Report the shortage within 24 hours of delivery

  • We will investigate and either dispatch the missing items or issue a refund for the missing products

5. DAMAGED PRODUCTS

5.1 Transit Damage

If products are damaged during delivery:

  • Note any visible damage on the delivery receipt before signing

  • Take photographs of the damaged packaging and products

  • Report the damage to us within 24 hours of delivery

  • Retain all packaging for inspection if requested

5.2 Resolution for Damaged Products

For verified transit damage, we will offer you the choice of:

  • A full refund including delivery costs

  • Replacement of the damaged products (subject to availability)

6. NON-RETURNABLE ITEMS

6.1 No Returns for Change of Mind

In line with industry practice for cannabis products, we do not accept returns or provide refunds for:

  • Change of mind

  • Products that did not meet personal expectations regarding effects, taste, or aroma

  • Products purchased by mistake

  • Products that you simply decided you do not want

6.2 Opened or Used Products

We cannot accept returns of opened or used products except in cases of verified defects or contamination. Once a product is opened, we cannot verify its handling, storage, or potential contamination.

6.3 Products Not in Original Condition

Returns will not be accepted for products that are not in their original condition are damaged, or have missing parts not caused by our error.

7. THE RETURNS PROCESS

7.1 Initiating a Return

To initiate any return:

  1. Email us at jasoncass79@gmail.com with your:

    • Order number

    • Name and contact details

    • Description of the issue

    • Photographs (where applicable)

  2. Our customer service team will respond with instructions

  3. Do not return any product without prior authorization

7.2 Return Authorization

All returns require a Return Authorization (RA) number. Returns sent without an RA number may be refused or delayed.

7.3 Packaging for Return

If instructed to return a product:

  • Use secure packaging to prevent further damage

  • Include all original packaging and contents

  • Write your RA number clearly on the outside of the package

  • Obtain proof of posting/delivery tracking

8. REFUNDS

8.1 Refund Processing

Approved refunds will be processed using the original payment method within 10 (TEN) business days of approval. Refunds may take additional time to appear in your account depending on your financial institution.

8.2 Refund Amounts

  • Defective/Incorrect/Damaged products: Full refund including original delivery costs

  • Unfulfilled orders: Full refund if we cannot fulfill your order

  • Partial returns: Refund will reflect only the returned items

8.3 No Double Refunds

If a replacement product has already been dispatched, a refund will not be issued for the original product unless the replacement is also defective.

9. REPLACEMENTS

9.1 Replacement Eligibility

Replacement products may be offered instead of refunds for:

  • Defective products

  • Incorrect items received

  • Damaged products

9.2 Replacement Process

  • Replacements are subject to product availability

  • If the exact product is unavailable, we may offer a similar product of equal value or a refund

  • Replacements will be dispatched after we receive the original item (unless we agree otherwise)

9.3 Replacement Delivery

Replacement products will be sent using the same delivery method as the original order. Delivery timelines for replacements may vary.

10. CANCELLATIONS

10.1 Order Cancellation before Dispatch

Orders may be cancelled before dispatch by contacting us immediately. If cancellation is confirmed before dispatch, a full refund will be issued.

10.2 Order Cancellation after Dispatch

Once an order has been dispatched, it cannot be cancelled. Standard return policies apply.

10.3 Cancellation by G Bliss

We reserve the right to cancel any order if:

  • Payment is not received or is reversed

  • Suspected fraud or unauthorized transaction occurs

  • Age verification cannot be confirmed

  • The product is unavailable

  • Delivery is not possible in your area

In such cases, a full refund will be issued.

11. DELIVERY COSTS FOR RETURNS

11.1 Returns Due to Our Error

If the return is due to our error (wrong item, defective product, damaged goods), we will cover all reasonable return delivery costs .

11.2 Other Returns

For any other returns, you are responsible for the cost of returning the product to us. We recommend using a tracked delivery service as we cannot accept responsibility for items lost during return transit.

12. PRODUCT RECALLS

12.1 Recall Process

In the unlikely event of a product recall, we will follow the Product Safety Guidelines issued by the National Consumer Commission. This may include:

  • Public notice of the recall

  • Direct communication with affected members

  • Instructions for returning or disposing of affected products

  • Full refunds or replacements for recalled products

12.2 Safety Notification

If we become aware of any safety issue with products sold, we will notify affected members immediately regardless of whether an official recall is initiated.

13. EXCEPTIONS AND DISCRETION

13.1 Case-by-Case Consideration

While this Policy sets out our standard approach, we may consider exceptional circumstances on a case-by-case basis. Any discretionary decisions do not create ongoing obligations or waive future application of this Policy.

13.2 Fraudulent Returns

We reserve the right to reject returns and refuse service to anyone who attempts fraudulent returns or repeatedly claims false defects.

14. WARRANTY INFORMATION

14.1 No Express Warranties

Except as required by law, we provide no express warranties for our products. Any implied warranties are limited to the minimum period and extent required by the CPA.

14.2 Duration of Claims

Claims regarding product quality must be reported within a reasonable time after discovery, generally within 7 (SEVEN) days of delivery for visible issues and within the product's reasonable lifespan for latent defects.

15. AGE VERIFICATION FOR RETURNS

15.1 Return Handling

Any physical return of products will only be accepted from persons over 18 years of age. Return shipments must be signed for by an adult.

15.2 Refunds to Verified Members

Refunds will only be processed to the original G Bliss Club member who placed the order, not to third parties.

16. GOVERNING LAW

This Return and Refund Policy shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising under this Policy shall be subject to the jurisdiction of the South African courts.

2. DEFINITIONS

4.4 No Liability for Delays

To the maximum extent permitted by law, G Bliss shall not be liable for any delay in delivery caused by events outside our reasonable control or the reasonable control of our Delivery Partners. This includes, but is not limited to, the factors listed in clause 4.3 above.

5. THE DELIVERY PROCESS

5.1 Order Confirmation and Dispatch Notification

  • Once your order is placed, you will receive an order confirmation email

  • When your order is dispatched from our facility, you will receive a dispatch confirmation email containing:

    • Tracking number(s)

    • Link to track your package on the courier's website

    • Estimated delivery date (if available)

5.2 Tracking Your Order

You may track your order using the tracking link provided in your dispatch email. Please note that tracking information is provided by the Delivery Partner, and there may be delays in updating tracking status.

5.3 Delivery Attempts

Our Delivery Partners will generally attempt delivery during business hours (typically between 08:00 and 17:00 on weekdays).

First Delivery Attempt:

  • Courier will attempt delivery to the address provided

  • A signature from a person over 18 years is required

  • If no eligible person is available, the courier may:

    • Leave a notification card with contact details

    • Attempt re-delivery on the next business day

    • Return the package to a local depot for collection

Second and Subsequent Attempts:

  • If delivery is unsuccessful after the first attempt, the courier may attempt a second delivery

  • Some couriers may charge an additional fee for second delivery attempts

  • If delivery continues to be unsuccessful, the package will be returned to our facility

5.4 Collection from Courier Depot

If delivery attempts are unsuccessful, the package may be held at the courier's local depot for collection. In such cases:

  • You will be notified of the depot location and collection instructions

  • Collection must be made within the courier's specified time frame (usually 3-5 business days)

You are responsible for providing a complete, accurate, and deliverable delivery address. This includes:

  • Postal code

  • Any special delivery instructions (e.g., gate code, security contact)

7.2 Address Changes

Once an order has been placed and payment confirmed, we may not be able to change the delivery address. Please contact us immediately if you need to correct your address. We will attempt to accommodate changes, but cannot guarantee that changes can be made once the order is processed.

7.3 Consequences of Incorrect Address

If delivery fails due to an incorrect or incomplete address provided by you:

10. LOST, DAMAGED, OR DELAYED PACKAGES

10.1 Damaged Packages

If you receive a package that appears damaged:

  1. Note the damage on the delivery receipt before signing

  2. Take photographs of the outer packaging and the damaged products

  3. Do not dispose of the packaging or products

  4. Report the damage to us within [24/48] hours of delivery

We will investigate and, if the damage is confirmed, offer you a choice of:

  • Replacement of the damaged products (subject to availability)

10.2 Lost Packages

Our Delivery Partners are not common or public carriers. They reserve the right to:

  • Refuse to accept any goods for carriage at their discretion 

  • Select the route and method of transport 

  • Use sub-contractors to perform deliveries 

  • Inspect packages to ensure compliance with their prohibited items list

 

13.3 No Liability for Courier Acts

To the maximum extent permitted by law, G Bliss shall not be liable for any acts or omissions of our Delivery Partners, including but not limited to loss, damage, or delay caused by the courier. We will, however, take reasonable steps to assist you in resolving issues with the courier.

14. FORCE MAJEURE

Neither G Bliss nor our Delivery Partners shall be liable for any failure or delay in performance of our obligations under this Policy arising out of or caused, directly or indirectly, by circumstances beyond our reasonable control, including but not limited to:

  • Acts of God (flood, earthquake, storm, hurricane, fire)

  • War, terrorism, riot, civil commotion

  • Labour disputes, strikes, lockouts

  • Government actions, regulations, or embargoes

  • Power outages, telecommunications failures

  • Pandemics, epidemics, or public health emergencies

  • Theft, hijacking, or criminal activity
